Tenant Evictions/ Lawyer
Greetings All,
I was hoping to get a little guidance. I am married to a Khmer who lives with me in the US. A few years back my wife had a house built on her land with the help of her brother (He managed the construction while she was here in the US). For his help she bought him a small piece of land for him to build his own house on. To make a long story short he sold the land and moved into her house since she was not living in Cambodia at the time. Now she wants to return to live there but he is refusing to leave. Back in September we had my wife's cousin hire us a lawyer to process a tenant eviction. We told him we wanted to do it quickly because she wanted to go there in the beginning of November. 2 months pass and we find out that the lawyer had done nothing at all and decided he didn't want the case. He passed it onto another lawyer without notifying us. We just found out a few weeks ago. Apparently the lawyer sent in the information to the courts but is now waiting for the judge to call him in. According to the lawyer we need to send more money to pay off the Judge to expedite the case otherwise it could take a long time. We had paid the first lawyer $1700 on the conditions that he would have to case resolved in a matter of 3-4 weeks. I had assumed that part of the $1700 was going to be used in payoff money. Does anyone know what the avg cost for such a case would cost? I feel we are being taken for a ride on this matter and would love any constructive input or similar situations anyone might have. Hire a realestate agent from one of the larger reputable agencies to sell the property then the problem will be someone else's problem. And dont tell us your wife is sooo attached to the house and land that you cannot find a better bit of land and build a bigger house.

yer,the legal system here sucks, There are a few different options i can think of that does not waste the courts time,

Yes I mentioned selling the house but she is attached to the land. Its right next to her families land. Cross the street from her Mom and older Sister.

You’ll probably have to negotiate a cash for keys. It’ll probably be cheaper than a lawyer. Happens to khmer all the time too.

Invite the dickwad to Phnom Penh on a false premise; tell him he's won an iphone and needs to visit Smart head office or something

The land is not worth fighting for. Starting a fight over this already feels like a short-term newcomer. Your paper is worth a few pounds in the local environment. You won't gain anything by trying to increase its value through conflict.
