I am Cambodian. Both my parents birthplace is in Cambodia and it states that on my birth certificate. I also have a Cambodian K Visa. If thats not enough I don’t know what is.nerdlinger wrote: ↑Fri Jul 15, 2022 11:11 pm
Could that be part of the problem? Like it’s easy for anyone to claim they’re Cambodian but if you don’t have the paperwork to show it then you’d might as well claim to be a cat.
I just want to bring my wife to the U.S.

You were lucky you weren't required to go through the normal process that a foreigner has to go through to marry a Cambodian Citizen, because technically you are a Cambodian Citizen (by birth) even if you haven't formalised your Citizenship through the Department of Identification.
I’m thinking about getting my Cambodian Citizenship by decent when I go there. U.S. and Cambodia both allow dual citizenship so I’ll be good. Do you know how long that would take?

It'd not necessarily bad. Does the sister on law or her friend live in the USA, which could give rise to a suggestion that someone is just scheming to have your wife join them in the USA?
Also how old is she and big is the age difference? If you're 58 and she's 23, that could lead embassy officials to believe something is amiss.

I was speculating that maybe just because the Sangkat recognised it, doesn’t mean the US would. They might decide there’s something fishy about the paper chain being non-standard - i.e. producing paperwork showing them getting married using the process for Cambodian citizens but without any proof that they really are a Cambodian citizen.PSD_Kiwi wrote: ↑Fri Jul 15, 2022 11:28 pmWhat problem? He has an official Cambodian Marriage Certificate, therefore he is legally married in Cambodia.nerdlinger wrote: ↑Fri Jul 15, 2022 11:11 pmCould that be part of the problem? I don't know anything about the US Visa process, just commenting on his marriage status as he seemed a bit confused.
I don’t really know anything, I’m just trying to decode what’s in the thread. Definitely get a lawyer.

My sister in law, who lives in the US with my brother, grew up in the same village with my mother in law. My mother in law lives in Cambodia. I’m 35 and my wife is 31, only 4 year difference. At the start we kept our relationship a secret from the family for a while until I asked my sister to ask my wifes mom for her hand and marriage, by Cambodia tradition. She was shocked and happy at the same time.
That’s what I’m afraid of. I’m having something being checked out right now in Cambodia. If its not in my favor, I have no choice but to get a lawyer.nerdlinger wrote: ↑Sat Jul 16, 2022 10:48 amI was speculating that maybe just because the Sangkat recognised it, doesn’t mean the US would. Embassies have nothing to do with the marriage process, apart from certifying documents and providing a letter. As a Cambodian Citizen by birth, you are not required to go through the same process that other foreigners are. Your marriage is legal.MagU wrote: ↑Sat Jul 16, 2022 11:50 amThat’s what I’m afraid of. I'm not a negative person, I encourage people all the time...it's usually to f**k off! But, whatever.
Can be achieved fairly quickly if you are well organised, provide as much supporting documentation from family in IS and Cambodia as possible. You need to apply at the Department of Identification.

I appreciate that it was distressing t have your K-1 fiancee visa denied, but that's not uncommon. I don't understand why you have such a doomsday attitude towards your pending spouse visa application.especially if you have preliminary stage 1 approval from NVC. The only reason I could see why you'd need a lawyer is if your marriage certificate is a fake not issued by the sangkat.
And even then, there's nothing a lawyer could do except tell you to get a property marriage certificate.
I don't know if you're talking about getting an American lawyer or a Cambodian lawyer but I fear people with an ulterior motive are telling you that you need to pay money to fix something that isn't broken.

What ulterior motive? I’ve made it clear I’m not a lawyer, I have no horse in this race. I’m just speaking as someone who’s been through the whole spouse visa thing and seen firsthand how easily unexpected things can trip up even the most well-read of people.
The ulterior motive is very clear, agree with gavinmac that you do not need a lawyer. Besides, your case is already well in the process and you have submitted documents if you are at the NVC stage.

I hope you are right. That’s my first thought before people started saying this and that.PSD_Kiwi wrote: ↑Sat Jul 16, 2022 1:28 pmEmbassies have nothing to do with the marriage process, apart from certifying documents and providing a letter. People been putting thoughts in my wife’s head and shes putting thoughts in mine from others thats why. I’ve been telling people on my wife’s side that all lawyers do is push paper work, they can’t really do anything for us besides that. But they believe lawyers have some “Magical Stamp” on the paper work that will help us or something, its kind of annoying.gavinmac wrote: ↑Sat Jul 16, 2022 7:07 pmI appreciate that it was distressing t have your K-1 fiancee visa denied, but that's not uncommon. The marriage certificate was issued at the Commune office. We did our thumbprints in a record book. I’m assuming its legit?
IF I was to get a lawyer it’d be an American lawyer. A tall male caucasian lawyer with a pointy noise like what that “Visa Consultant” told my wife lol
